Snyder Performance Engineering Minimum Advertised Price Policy
1. Introduction
We at SPE understand that our success is tied to the success of our select dealer
network. We also recognize the amount of time and resources our dealers invest to
deliver quality products and services to customers. Our goal is to assist our dealers
in moving their business in a positive direction, by discouraging negative practices
such as price-based advertising. For this reason, SPE has unilaterally established
a Minimum Advertised Price (MAP) Policy.
2. Policy Statement
SPE reserves the right to discontinue doing business with any reseller that advertises
any product(s) covered by this MAP Policy at a price lower than MAP.
3. General Guidelines
a. The products covered by this policy are any product listed on the SPE Price Sheet
with a MAP.
b. MAP applies only to advertised prices and not apply to the price at which the products
are actually sold or offered for sale to an individual consumer within the dealer’s retail
location or over the telephone.
c. SPE may run a sale from time to time and in such case, the MAP will be the same as the sale
price on those particular products on those particular dates.
d. MAP does not establish a maximum advertised price. Dealers may offer SPE products at any price above MAP.
4. Advertising Guidelines
a. MAP Policy applies to all advertisements of SPE products in any and all media, including but not limited to flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, television, radio, and public signage, as well as Internet sites, social media or any other form of electronic data.
b. Website features such as “click for price”, automated “bounce-back” pricing e-mails, pre-formatted e-mail responses, forms, and automatic price display for any items prior to being placed in a customer’s shopping cart, and other similar features are considered to be communications initiated by the dealer (rather than by the customer) and thereby constitute “advertising” under this MAP Policy.
c. It shall not be a violation of this MAP Policy to advertise that a customer may “call for price” or “email for price”, or to use similar language, specifically with respect to SPE Products, so long as no price is listed.
d. If pricing is displayed in any other than a brick and mortar retail store, any strike-through or other alterations of the MAP is prohibited.
5. E-Bay and Other Auction Website Guidelines
a. For auctions, opening bid and/or reserves must start a MAP without a “Buy it Now” option.
b. Best offer auctions are prohibited.
c. “Buy it Now” options must be listed at a price equal to or greater than MAP.
6. Policy Enforcement
a. SPE monitors the advertised prices of dealers, either directly or via 3rd party agencies or tools. Dealers are expected to provide reasonable cooperation in any SPE investigation regarding possible MAP Policy violations. Hindering, obstructing, delaying, or otherwise failing to cooperate is a violation of this MAP Policy.
b. If a dealer with multiple retail locations violates this MAP Policy at any one location, or on any associated website, SPE will consider this a violation of MAP Policy by the dealer.
c. SPE reserves the right to cancel any pending orders, restrict future orders, or suspend dealers’ account if SPE reasonably believes:
i. a dealer has violated this MAP Policy; or
ii. a dealer intends to violate this MAP Policy.
d. The SPE MAP Policy Administrator is solely responsible for determining whether a violation of the MAP Policy has occurred, as well as determining appropriate sanctions.
e. SPE MAP Policy will be enforced by SPE in its sole discretion and without notice. Violations of this policy may result in any of the aforementioned sanctions up to and including termination of our business relationship, as well as any available remedies at law.
